Terms and Conditions of Driving Tuition

Introduction
At Panchal Driving Academy, we are committed to providing high-quality driving lessons and an excellent customer experience. Our aim is to deliver professional, structured and enjoyable tuition, helping pupils develop the skills, knowledge and confidence required to become safe and responsible drivers.
Panchal Driving Academy is owned and operated by Mr. Jitesh R. Panchal, a fully qualified Approved Driving Instructor (ADI) registered with the Driver and Vehicle Standards Agency (DVSA).
We are committed to maintaining professional standards in accordance with applicable legislation, DVSA requirements and the Driving Instructor Code of Practice.
These Terms and Conditions set out the responsibilities of both Panchal Driving Academy and our pupils.
All pupils are required to read and accept these Terms and Conditions before commencing tuition. Acceptance may be recorded electronically through the Panchal Driving App, by email or through another agreed written method.
- Tuition and Legal Requirements
To receive driving tuition, pupils must:
- Hold a valid UK provisional or full driving licence appropriate for the vehicle being driven.
- Meet the legal minimum age requirements for learning to drive.
- Be legally entitled to drive in the United Kingdom.
- Meet the required eyesight standards, including being able to read a modern vehicle registration plate from 20 metres.
- Inform their instructor of any licence endorsements, disqualifications or restrictions affecting their entitlement to drive.
- Disclose any relevant medical conditions, medication or other circumstances that may affect their ability to drive safely.
The instructor will check the pupil’s driving entitlement and eyesight as appropriate before tuition commences. The pupil is responsible that they meet the legal eye sight requirements for the practical test.
Pupils must wear suitable footwear and clothing that does not interfere with the safe operation of the vehicle.
Panchal Driving Academy reserves the right to refuse or discontinue a lesson where a pupil is considered unfit to drive, including because of alcohol, drugs, illness, fatigue or other safety concerns.
Any charges arising from an interrupted lesson will be assessed reasonably according to the circumstances.
- Professional Conduct and Safeguarding
Panchal Driving Academy is committed to maintaining a professional, respectful and supportive learning environment.
All pupils will be treated fairly and with dignity, consideration and respect.
We maintain appropriate professional boundaries and take safeguarding responsibilities seriously, particularly when teaching young people and vulnerable adults.
Unnecessary physical contact, discrimination, harassment, threatening behaviour and inappropriate communication will not be tolerated.
The instructor may intervene physically where reasonably necessary to prevent an immediate danger.
Pupils are expected to behave appropriately towards their instructor, other road users and members of the public.
Panchal Driving Academy reserves the right to discontinue tuition where there are reasonable grounds relating to safety, inappropriate behaviour or a serious breakdown in the professional working relationship, subject to applicable legal and refund obligations.
- Driving Lessons and Appointments
All driving lessons at Panchal Driving Academy are provided on a one-to-one basis.
Pupils will not be required to collect or drop off other learners during their paid tuition time.
Lesson duration, dates, times and collection arrangements will be agreed between the instructor and pupil before the appointment.
Pupils may request collection from home, work, college or another suitable location, subject to prior agreement and availability.
Parents, guardians or other accompanying persons may attend lessons by prior arrangement, where appropriate and safe.
The agreed lesson duration includes relevant instruction, briefings, driving practice and constructive feedback.
Panchal Driving Academy will make every reasonable effort to arrive punctually and provide the full agreed lesson duration.
Where a lesson is shortened or cancelled by the instructor, appropriate replacement tuition or a refund for undelivered tuition will be offered.
- Pupil Progress and Training Records
Panchal Driving Academy provides structured driving tuition tailored to each pupil’s individual needs, abilities and rate of learning.
Throughout their training, pupils will receive constructive feedback on their driving performance, strengths, areas requiring improvement and future training requirements.
Lesson attendance, tuition hours delivered, payments and progress information will be recorded using the Panchal Driving App or another suitable recording system.
Pupils may request information about their lesson history and current progress.
The instructor will provide an honest professional assessment of the pupil’s readiness for the practical driving test.
There is no guaranteed number of lessons required to reach test standard, and Panchal Driving Academy cannot guarantee a driving test pass.
Our objective is to develop safe, responsible and independent drivers, rather than simply teaching pupils to pass a test.
- Tuition Fees and Payments
Tuition fees are agreed before lessons commence.
Our currently advertised lesson prices include:
- Standard one-hour lesson: from £38.
- Eligible student one-hour lesson: from £36.
- Ten-hour block package: from £350.
- Twenty-hour block package: from £680.
Additional charges may apply to certain locations, including Loughborough, and different rates may apply to specialist tuition or other lesson packages.

The price, duration and any applicable package conditions will be confirmed before payment.
Tuition fees are payable in advance or at the start of the agreed lesson, unless alternative arrangements have been made. Payment of lesson must be made prior to lesson or during the end of the lesson. Failure of payment will result in cancellation of future lessons.
Payment may be made using an accepted payment method agreed with the instructor.
Panchal Driving Academy reserves the right to revise tuition prices. Pupils will be informed of relevant changes in advance, and prices already agreed for prepaid lessons will be honoured.
Payments received, lessons completed and outstanding prepaid lesson balances will be accurately recorded.
- Block Bookings and Refunds
Discounted block-booking packages must be paid for in full at the time of purchase, unless otherwise agreed.
Block bookings are intended to be completed within six months of purchase.
Where lessons remain unused after six months, pupils may request a refund of their outstanding entitlement or discuss an extension with the instructor.
Where a pupil chooses to end a discounted block booking early, lessons already delivered may be recalculated at the standard hourly rate applicable at the time of purchase, provided this condition was disclosed and agreed when the package was bought.
Any deductions must be reasonable and fair under consumer law. The value of lessons already provided and any lawful charges will be explained, and any remaining refundable balance returned.
Where applicable, pupils retain their statutory cancellation rights for online, telephone or other distance bookings.
For qualifying contracts, a 14-day statutory cancellation period may apply. If a pupil expressly requests tuition to begin during this period and subsequently cancels, an appropriate charge for services already delivered may apply in accordance with the law and the information supplied at booking.
Refunds will normally be made using the original payment method where reasonably practicable.
Panchal Driving Academy will not unfairly withhold payment for tuition that has not been provided.
- Lesson Cancellations and Missed Appointments
Pupils must provide a minimum of 48 hours’ notice when cancelling or rearranging a driving lesson.
Where less than 48 hours’ notice is given, a cancellation charge of up to the agreed lesson fee may apply, reflecting the reasonable loss resulting from the cancellation and taking account of whether the appointment can be filled.
Pupils who fail to attend an agreed appointment without notice may also be liable for a reasonable cancellation charge.
Cancellations must be communicated directly to the instructor by telephone, text message or another agreed communication method.
Pupils should ensure their cancellation has been received and acknowledged.
If Panchal Driving Academy cancels a lesson, an alternative appointment will be offered or payment for undelivered tuition refunded where appropriate.
If the instructor is delayed, the pupil will be informed as soon as reasonably practicable.
The Panchal Driving App may send appointment reminders as a complimentary service. However, pupils remain responsible for keeping a record of their agreed lesson dates and times.
Failure to receive an automated reminder does not automatically cancel an appointment.
Exceptional circumstances affecting either party will be considered reasonably.
- Practical Driving Tests
Pupils are responsible for booking, changing and cancelling their own DVSA car practical driving tests.
Pupils are strongly advised to discuss their proposed test date and readiness with the instructor before making a booking.
Panchal Driving Academy will provide guidance on driving-test readiness, but the final decision about entering a test remains with the pupil.
The DVSA currently requires at least 10 full working days’ notice to cancel or change a car driving test without losing the test fee, subject to its published rules and exceptions.

Panchal Driving Academy reserves the right to decline use of the tuition vehicle for a practical driving test where there are reasonable concerns about the pupil’s driving ability, safety, legal entitlement or readiness to meet the required standard.
Such concerns will be explained as early as reasonably practicable, allowing the pupil time to consider their options.
The tuition vehicle is not hired separately for the driving test. Pupils pay the agreed tuition rate for the booked test-day period, which normally includes the journey to the test centre, the practical test and the return journey.
The total test-day tuition charge and duration will be agreed before the appointment.
The DVSA practical test fee is payable separately.
If the DVSA cancels a test at short notice, any tuition already provided remains chargeable, while payment for undelivered tuition will be dealt with fairly according to the circumstances. The 48hr short notice cancellation will still apply but the pupil can claim reimbursement directly from the DVSA.
- Vehicle Safety, Insurance and Liability
Panchal Driving Academy will provide a suitable, roadworthy tuition vehicle maintained and insured for professional driving instruction.
The vehicle will be equipped with appropriate safety equipment and dual controls.
Pupils must comply with road traffic legislation and follow reasonable safety instructions.
Pupils are responsible for their own driving conduct and may be personally responsible for traffic offences committed while driving, as provided by law.
Where damage occurs to the tuition vehicle, responsibility for any costs will be assessed according to the circumstances, applicable insurance arrangements and legal responsibilities.
Pupils will not automatically be held liable for the full cost of vehicle repairs simply because an incident occurs during a lesson.
The pupil is responsible for any damage incurred to the tuition vehicle as a result of negligence during the practical driving test.
Panchal Driving Academy will exercise reasonable care in providing tuition but cannot guarantee the outcome of a practical driving test.
Nothing in these Terms and Conditions excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence.
- Personal Property
Pupils are responsible for taking reasonable care of their personal belongings during lessons.
Panchal Driving Academy recommends that valuables are not left unattended in the tuition vehicle.
We will take reasonable care of belongings entrusted to us, but responsibility for any loss or damage will be determined according to the circumstances and applicable law.
- Data Protection, Privacy and Recording Equipment
Panchal Driving Academy is committed to protecting the personal information of its pupils.
Personal data will be handled in accordance with UK GDPR, the Data Protection Act 2018 and other applicable legislation.
Information may be collected and processed for purposes including:
- Managing lesson bookings and appointments.
- Recording pupil attendance and training progress.
- Processing payments and maintaining financial records.
- Communicating important lesson or business information.
- Meeting legal, safeguarding and insurance obligations.
- Dealing with enquiries, complaints and other legitimate business requirements.
Information may be managed using the Panchal Driving App and other appropriate systems.
Our tuition vehicle will be fitted with dashcams or recording equipment used for road safety, incident investigation, insurance purposes and appropriate training activities.
Pupils will be informed of relevant recording arrangements. Identifiable recordings will not be publicly shared for promotional purposes without the necessary permission.
Personal data will be securely managed and retained only for as long as necessary for the relevant lawful purposes.

- Photography and Social Media
At Panchal Driving Academy, we take great pride in celebrating our pupils’ achievements.
As part of our established business practice, we regularly invite successful pupils to have photographs taken alongside our tuition vehicle and share their achievements through our website, social media and other promotional channels.
We encourage pupils to take part in celebrating their success. Identifiable photographs, videos and personal information will only be published for marketing purposes with separate, explicit written permission.
- Customer Care and Complaints
Panchal Driving Academy strives to provide a professional, reliable and enjoyable learning experience.
We value feedback and encourage pupils to raise any concerns directly with the instructor at the earliest opportunity.

We aim to acknowledge complaints within five working days and provide a response within 14 calendar days wherever reasonably possible.
Where further investigation is required, the pupil will be kept informed.
Complaints and their outcomes will be recorded appropriately.
Nothing in this section affects a pupil’s statutory consumer rights.
- Copyright and Website Content
The Panchal Driving Academy name, logo, original photographs, training materials, website content and other intellectual property belonging to the business must not be reproduced or used commercially without prior permission.
Any third-party trademarks, photographs or materials remain the property of their respective owners.
- Changes to Terms and Conditions
Panchal Driving Academy may update these Terms and Conditions to reflect changes in legislation, DVSA requirements or business arrangements.
The latest version will be made available on our website.
Material changes affecting existing pupils will be communicated where appropriate, and no changes will retrospectively remove existing contractual rights without a lawful basis or agreement.
Pupils are encouraged to retain a copy of the terms accepted at the start of their tuition.
